In short
This policy sets out what a domain registered through DomeniuLiber.ro may not be used for, how we enforce the rules and how you can report abuse to us. It forms part of the Terms and Conditions of MIRAKL SRL.
We do not host websites, e-mail or files: the content of a website is located with the hosting provider chosen by the domain holder. We can act on the domain (for example we can suspend it or ask the registry to do so), not on content hosted elsewhere.
Who this policy applies to
The policy applies to all customers and holders of domains registered through us, and to anyone who uses such a domain with their consent. The customer is responsible for how the domain is used, including by those to whom they give access (for example the hosting provider or the website developer).
Prohibited uses of a domain
A domain registered through us may not be used for:
- phishing, websites that impersonate other organisations or people, fake shops and other forms of fraud;
- distributing malicious software (malware, viruses, ransomware) or hosting command-and-control servers for botnets;
- pharming or other fraudulent redirection of traffic via DNS;
- spam: sending unsolicited commercial messages (Article 6 of Law no. 365/2002 and Article 12 of Law no. 506/2004) or promoting the websites on the domain through spam;
- child sexual abuse material (CSAM) or any content that sexualises minors. Such cases are reported to the authorities and the domain is suspended immediately;
- terrorist content or content that incites violence, hatred or discrimination;
- infringement of trade marks or other rights (for example the abusive registration of a name in order to resell it to the trade mark owner);
- any other activity that is illegal under Romanian law or European Union law, or prohibited by a court decision or by an order of a competent authority.
Domains are also subject to the rules of the competent registry (for example the ROTLD Registration Rules or the policies of ICANN and of the registrar).
How we enforce the policy
We learn about possible breaches from the reports we receive, from requests by authorities and registries, and from public blocklists. We do not generally monitor how domains are used. Decisions are taken by a person on our team, diligently, objectively and proportionately, taking into account the rights and legitimate interests of all parties, including freedom of expression and information. Depending on the seriousness, we may take one or more of the following measures:
- notifying the customer and asking them to fix the problem within a reasonable time;
- referring the person who sent the report to the website's hosting provider, where the content is located;
- locking the domain against transfer or changes while the matter is being reviewed;
- suspending the domain (the domain stops working but remains registered);
- terminating the contract and, where the registry's rules allow, deleting the domain, in serious or repeated cases.
In urgent cases (for example CSAM, active phishing or spreading malware), we may act immediately, before notifying you, and we will then inform you without delay.
Reporting abuse
Anyone can report a domain registered through us that is being used abusively or illegally:
- through the online form at Report abuse (recommended), which automatically creates a ticket and sends you a confirmation by e-mail; or
- by e-mail to [email protected].
For a report to be reviewed quickly, it must include:
- the domain name and, where applicable, the exact URL where the problem appears;
- an explanation of why you believe the domain is being used illegally or abusively, with evidence if you have it (for example the full header of a phishing e-mail);
- your name and e-mail address, except for reports concerning child sexual abuse, which may also be sent anonymously;
- a statement confirming your good-faith belief that the information in the report is accurate and complete.
For reports concerning trade marks or other rights, also state the rights relied on and your capacity (rights holder or representative). We do not settle disputes over the right to a domain name: these follow the registry's procedures (for .ro mediation, arbitration or the courts; for generic extensions the UDRP).
What happens after a report
- Confirmation. We send you an acknowledgement of receipt by e-mail without delay, if you have given us an address.
- Review. We review the report in a timely, diligent and objective manner. We may ask you or the customer concerned for further information and, where the nature of the case allows, we may give the customer the opportunity to present their point of view.
- Decision. We decide whether or not to take action on the domain and we communicate the decision to you, together with the available means of redress.
Statement of reasons and means of redress
If we suspend or lock a domain or terminate the contract for breach of this policy, we send the customer, at the latest when the measure is applied, a clear explanation: the measure taken and its duration, the facts on which it is based, whether it was taken following a report or on our own initiative, the legal ground or contractual clause breached, and the means of redress. We do not send the explanation if a competent authority prohibits us from informing the customer (for example, so as not to jeopardise a criminal investigation).
Means of redress, both for the customer and for the person who sent the report:
- internal complaint: you can write to us at [email protected] within 6 months of being notified of the decision, stating the ticket number and the reasons why you consider it wrong. The complaint is reviewed by a person, and the decision may be reversed if it proves unfounded;
- out-of-court settlement: consumers can turn to alternative dispute resolution (ADR, in Romanian SAL) entities through ANPC, at https://reclamatiisal.anpc.ro; any party may use mediation, under the conditions laid down by law;
- complaint to the authority: you can lodge a complaint with ANCOM, the Digital Services Coordinator for Romania;
- the courts: you can at any time bring the matter before the competent courts in Romania.
Threats to life or safety
If we become aware of information giving rise to a suspicion that a criminal offence involving a threat to the life or safety of one or more persons has taken place, is taking place or is likely to take place, we promptly inform the competent law enforcement or judicial authorities and provide them with the information available. We also cooperate with the competent authorities and comply with their orders, under the conditions laid down by law (Article 16 of Law no. 365/2002).
